US Military Leaders knew of prisoner abuse early

    Well seeing as they are in charge I would say that they both knew that it would happen and that they probably knew pretty soon after it did happen. Both the things directly condoned and more or less ordered and those things committed by some overzealous agents or soldiers.

    Think about it, constitutional rights aren't limited to fair trial and the concept of "nulla poena sine lege", according to this argument it also includes that detainees have no right of physical and psychical integrity.

    Mr. Boyle's argument sums up as :spin: The President is allowed to do whatever he wants and whatever he deems necessary to be done and constitution and no friggin' court can do anything against it :spin:

    After the Reichtagsbrand the German parliament decided it no longer needed the constitution because the present danger made it necessary that strong leadership is exercised without constitutional restraints. It's not as if Germany didn't have a constitution then, we simply perferred not to use it for reasons of convenience.

    There are actually three ways to learn - #1 is through insight, the rarest way, #2 is from other people's mistakes and #3 is by screwing up yourself and get it the hard way.

    I think America under Bush has actually reached a point of choice between the rule of the persident and the rule of law. American law went a long way: In Nuremberg they had a distinct problem with the concept of the Führerbefehl. Today Bush's ultra-reactionary adminstration lives the concept. A new low.

    @ Cesard: I haven't lost sight of that, believe me. Once you start thinking that way, you've already taken a running jump onto the slippery slope. Torture + Confession = Post-Facto Justification of Actions? Give me a break.
