    Not necessarily. Iirc such debts, as in this case are inheritable. She could fight on against his heirs.

    I'm not a lawyer, but I believe the operative word is "debt". As of his death there was no legal obligation. I believe that it will be really hard to get a judgement against someone who is deceased when they cannot be deposed or defend themselves.

    I believe the same issue came up with the death of Ken Lay which caused all of the Enron lawsuits against him to be dismissed and to save his family uncounted millions.

    But Ken Lay died after his trial - it was just before sentencing. He was found guilty in a court of law. I agree that in this case, since Breitbart died before it ever went to trial, there isn't a hell of a lot you can do. But Lay died after he was convicted...

    I think you could go after his estate ...? I don't think damages are necessarily limited by whether or not the defendant is alive. If there's money to be made, an attorney will find a way.

    True, but he was awaiting an appeal and I believe that is what ended up voiding the conviction.

    Once again, I believe you can only go after an estate for a debt. If the debt isn't established before the death I don't think you can do anything.

    I trust that you have more knowledge about these matters than me Snook, but I can think of some other examples ... e.g, victim of a serious auto-injury accident where the at-fault driver was killed?
