    Another case of government being inflexible with respect to the law.

    Short version: Girl saves baby woodpecker. Unluckily caught by Fish and Wildlife officer in a store who tells them it's illegal because the woodpecker is protected. They release the bird as soon as they get home and told Fish and Wildlife they had done so. Later same officer shows up with state trooper with citation and fine for $535.

    How ridiculous is that?

    ...Upon speaking with the subject, later identified as Alison Capo, on June 27, the agent determined that no further action was warranted. A citation that had been previously drafted by the agent was cancelled on June 28.

    Unfortunately, the citation was processed unintentionally despite our office's request to cancel the ticket. The Service has contacted Ms. Capo to express our regret. The Service is also sending Ms. Capo a formal letter explain the clerical error and confirming that ticket should never have been issued.

    Ok, so they basically cancelled the inquiry, but it was already under way and a citation was processed. It is a bit strange that a citation would have to be cancelled rather than confirmed in such a case, but I am no specialist on bureaucratic procedures. Anyway, as I'm seeing it the Fish and Wildlife service owes Mrs. Capo $535 (if they actually took them - how do citations work in the US, exactly), plus a week's worth of ice cream money for Ms. Capo.

    So if I decide to make woodpecker stew I just need to tell the authorities that I released the bird last week ... interesting.

    If you want to make woodpecker stew, just make sure you don't take the ones you've caught into a Lowes with you. Apparently that's where the Fish and Wildlife agents hang out :)

    Glad it was a clerical error after all. ;) Sometimes stuff like that happens. You're tired, you overlook something, then it looks like weird act or a horrible mistake. Pencil pushes don't have an easy life. ;)
