    A technique that's been used by Canadian police for the past decade or so for cases that have gone cold, OR for suspects that they have no evidence against.

    Technically, it doesn't trigger either the confessions rule or the Charter right to silence because the guy isn't speaking to someone that he perceives as being a state authority.

    But the techniques that are often used here are dirty, coercive, and all the rest of it. I'm in the middle of writing a paper to try and advocate either banning the practice or putting significant restrictions on its use.

    If people are stupid enough to fall for it they deserve to be in jail (yet another form of Darwinism in action). I actually think it's rather comical.

    [​IMG] There are too many idiots that also brag about crimes they did not commit. I think the practice in theory would work but would need certain conditions and restrictions to be viable in the long run. To be honest the validity could easily be called into question now the media is revealing about the subject.

    Well, while I understand the objections to the practise, they way I see it, if these guys didn’t do the crimes they are accused of, they’ve either done something else illegal, or will do so eventually, so I’m not going to lose any sleep over it. I know, people shouldn’t be convicted of crimes they haven’t committed, but honestly, if these guys are off the streets, so be it.

    I think I’ve been hanging around LKD too long. :p

    Yay, I'm a bad influence!

    But seriously, if the person not only confesses but re-enacts the crime, including details that were never released to the public, then it's pretty good evidence that they actually did commit the crime and are not just bragging about something they didn't do.

    In all honesty, I see where Beren is coming from, and convicting someone for a crime they did not commit is something that should be vigorously guarded against. Yet we should also guard against people getting away with serious crimes. I think it's a fair tool in the toolkit of the cops, but it does need to be regulated.

    I agree that this isn't entrapment. Entrapment would be encouraging them to commit a crime and then using that as evidence later. In this case, it is a crime that has already been committed. I also doubt that this brings about any "false confessions". I mean, if someone other than you killed somebody, why would you admit to it? And if you think you're joining a criminal ring to get rid of your legal problems, then clearly you aren't innocent.

    Well, the former defence lawyer in me still says there's a world of difference between 'legal innocence' and 'moral innocence.' :p

    Seems like basic undercover work to me. They have a suspect they think committed a crime and they send in undercover to find out. What is the difference between Mr. Big and any other undercover cop?
