    Go here

Hopefully she has the resources to get an attorney or knows of one that would help her out. I would love to be on the jury for this one.

[IMG] Small claims court...She can do it on her own. The amount in controversy is less than $500, so she can file a claim against EB there without an attorney. And based on the facts I read, it sounds like she'd win.

She can also file civil charges against the thief for restitution, but if the guy had to break into someone's house to getting less than $100 worth of video game stuff, I doubt she'll be collecting from him anytime soon.

Some merchants just haven't learned their lesson yet. This long time EB customer will probably never buy at EB again and the publicity of this case will turn off others as well. EB should have comitted their mistake and refund the money.

Wow - talk about quality customer service. I imagine that there are civil penalties that the local or state government can impose on EB for a clear violation of the law requiring them to hold second hand goods. I also imagine this little boneheaded move cost them significantly more than $87 in lost business, though.

Sounds like EB screwed things up. They should have denied buying them (PS2, games...) illegally in the first place -which one to believe: a honest merchant or thieving teen? Now that they were caught, they should had returned the money, sued the thief of the "damage" (and telling police who bought the stuff), and have him in the street.

This crime has got nothing to do with the fact that it was EB Games, but that its in the US. :p Kidding aside, thats one of the main reason that I never buy anything used. I even got FF Anthologies and FF VII last week from EB Games, and instead of getting it for about 15 bucks less, I bought a new copy of each.

    @ Virne,

How could they have known that the stuff was stolen? Is there a way of checking that right away?

Eagle, he means that when the ABC asked, they could've denied buying it and just said that the kid was lying when he told the cops where the items were.

[IMG] I got it now, but as honest as the boy was, he probably kept the receipt :D and that way EB would have been accused of lying and knowing right away the stuff was stolen ;)

Seems like EB really, really screwed it up.

The law says 15 days, they went for quick profit, so they should pay now. They acted in bad faith, so they're screwed. That's one.

Another one is contradictions in their excuses. Which means they are lying to save their butts. Why would they have to wait to verify Michelle's claims if they categorically weren't going to return the goods to her in the very first place? Spotted, dumbasses! If you lie, at least lie consistently, for decency's sake.

A touch of poetic justice comes with that they will lose much, much more than they would have been able to pay the lady and get away with the whole thing. They could even try recovering the whole sum from the thief, together with court and lawyer fees  Such is the price of greed. Minds of greedy people work in such a fashion that they become blind. That's good, actually. Makes me feel better when I see how greedy leeches pay unproportional prices for their stupidy. Being dumb is expensive, isn't it?

And don't kill all the lawyers or honest people will have to take up the trade ;)
